The National Industrial Court siting in Abuja today held that workers are entitled to Strike Actions as of right. In the judgment delivered by Hon. Justice Kanyip in the suit brought by the Federal Government of Nigeria & Attorney General of Federation against NLC & TUC on the proposed strike actions of the NLC/TUC over the President Buhari’s Government increase of PMS from N85 to N145 the court held that Nigeria is a member of ILO and ILO recognizes strike actions as a negotiation tool by the workers.

 Recall that the Federal Government of Nigeria through the application of the Attorney General of Federation, Mr. Abubakar Malami has sought and obtained an interim injunction issued by the Chief Judge of National Industrial Court, Hon. Justice Ade Adejumo, restraining the NLC and TUC from embarking on the proposed strike. The court, on Friday, July 15, 2016 held that the organized workers have right embark on strike to press home their demand be it economic, social and political in nature.

The court further stated conditions for such strike which includes; The obligation to give prior notice The obligation to give room for negotiation. The Court also held that the issue over the increase in petroleum products is not a trade dispute but outside that workers has right to embark on strike to drive home their demand provided those in essential services are excluded.

 Femi Falana, SAN & Sola Egbeyinka represented the NLC while Kayode Ajulo, Samuel Ajayi & Tosin Ojaomo represented TUC. The Federal Government was represented by Mr. Dayo Apata, the Director of Civil Litigation and A. Gazali, a Senior State Counsel.
